Access to and use of this site (’mediaforum.ie’) is provided by mediaforum.ie subject to the following terms:
1. You must read, agree with and accept all of the terms and conditions contained in the Terms of Use. If you do not agree to be legally bound by all the Terms of Use you may not use mediaforum.ie.
2. mediaforum.ie may change these terms at any time by posting changes online. You must accept these changes to enjoy continued use of mediaforum.ie. Your continued use of mediaforum.ie after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
3. You must comply with all reasonable instructions given by mediaforum.ie from time to time in connection with the use of the service.
Privacy and Data Protection
4. Registration on the mediaforum.ie requires you to provide personal details including a valid email address. This, and any other personal information about you will be held safely and securely by mediaforum in agreement with Data Protection Act. In particular, mediaforum.ie will not disclose your personal information to any third party except in the circumstances set out below.
5. mediaforum.ie may use your personal information to enforce their terms and conditions. We may also use the information if necessary in order to co-operate with all law enforcement enquiries and agencies and, if necessary, in actions by mediaforum.ie and/or third parties to enforce their intellectual property and/or other legal rights.
- 5.1 mediaforum.ie may use your subscribed email address to the site to send you regular information bulletins (ebulletins) with information about the site, MediaForum or activities or events of intersest and relating to the topic of interest of mediaforum.ie. Any request from you to be unsubscribed from such emailed bulletins will be respected in full.
Use of mediaforum.ie
6. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use mediaforum.ie content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any mediaforum.ie content except for your own personal, non-commercial use. Any other use of mediaforum.ie content requires the prior written permission of mediaforum.ie.
7. You agree to use mediaforum.ie only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of mediaforum.ie. Prohibited behaviour includes:
- harassing or causing distress or inconvenience to any person,
- being offensive or menacing, abusive, defamatory, or in breach of copyright,
privacy or any other rights, - infringing any third party’s trade mark, trade secrets, publicity, personal or proprietary rights,
- being in breach of any applicable laws or regulations,
- transmitting obscene or offensive content or disrupting the normal flow of dialogue within mediaforum.ie.
- transmitting any computer viruses, macro viruses, Trojan horses, worms
or anything designed to interfere with, interrupt or disrupt the normal operating procedure of mediaforum.ie or to surreptitiously intercept, access without authority any data or personal information, - enabling any hacking
- unsolicited mailbombing or spamming of mediaforum.ie or its members
Disclaimers and Limitation of Liability
8. mediaforum.ie content, including the information, names, images, pictures, logos and icons regarding or relating to mediaforum.ie and/or MediaForum Ltd, its products and services (or to third party products and services), is provided “AS IS” and on an “IS AVAILABLE” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
9. Under no circumstances will mediaforum.ie and/or MediaForum Ltd be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of mediaforum.ie regardless of the form of action.
10. mediaforum.ie and/or MediaForum Ltd does not warrant that functions contained in mediaforum.ie content will be uninterrupted or error free, that defects will be corrected, or that mediaforum.ie or the server that makes it available are free of viruses or bugs.
11. You can access other sites via links from mediaforum. These sites are not under our control and we are not responsible in any way for any of their content.
12. The views expressed on mediaforum.ie areas are those of members of the public and are not those of mediaforum.ie and/or MediaForum Ltd.
Intellectual Property
13. The names, images and logos identifying mediaforum.ie and/or MediaForum Ltd or third parties and their products and services are subject to copyright, design rights and trade marks of mediaforum.ie and/or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of mediaforum.ie, or any other third party.
Contributions to mediaforum.ie
14. Where you are invited to submit any contribution to mediaforum.ie (including any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant mediaforum.ie and/or MediaForum Ltd a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution, and in accordance with privacy restrictions set out in mediaforum.ie’s privacy policy. If you do not want to grant to mediaforum.ie and/or MediaForum Ltd the rights set out above, please do not submit your contribution to mediaforum.ie.
15. Further to paragraph 14, by submitting your contribution to mediaforum.ie, you:
- 15.1 warrant that your contribution
15.1.1 is your own original work and that you have the right to make it available to mediaforum.ie for all the purposes specified above;
15.1.2 is not defamatory; and
15.1.3 does not infringe any law. - 15.2 indemnify mediaforum.ie and/or MediaForum Ltd against all legal fees, damages and other expenses that may be incurred by mediaforum.ie and/or MediaForum Ltd as a result of your breach of the above warranty.
- 15.3 waive any moral rights in your contribution for the purposes of its submission to and publication on mediaforum.ie and the purposes specified above.
16. You agree to indemnify mediaforum.ie and MediaForum Ltd against any and all losses, costs, expenses or damages (including legal costs) arising as a result of any use or misuse of mediaforum.ie whether arising as a result of an action by a third party or otherwise.
17. You agree to use mediaforum.ie (including Message Boards) in accordance with the following House Rules:
About your posts:
- Contributions must be civil and tasteful.
- No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble.
- No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
- If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your accounts.
- Be patient: users of all ages and abilities may be taking part in mediaforum.ie.
- No spamming or off-topic material: we don’t allow the submission of the same or very similar contributions many times. Please don’t re-submit your contribution to more than one discussion, or contribute off-topic material in subject-specific areas.
- No advertising.
- No spoilers: material which contains plot developments which haven’t been transmitted on Irish analogue or digital television will be deleted unless submitted in a designated ’spoilers’ area.
- Contributions containing languages other than English may be removed.
- No impersonation.
- No inappropriate (e.g. vulgar, offensive etc) user names.
- Deliberate misuse of the complaints facility is not permitted. If you persist in doing this action may be taken against your account.
Safety
18. We advise that you never reveal any personal information about yourself or anyone else (for example: telephone number, home address or email address), and please do not include postal addresses of any kind. If you have a helpful address to share, inform the moderator using the ‘Contact Us’ link, and they will promote it if they see fit.
Complaints
19. If you have a complaint about any of the contributions posted on mediaforum.ie, or if you notice that a contribution contravenes any of these Terms of Use, then Contact Us (complaints@mediaforum.ie) immediately and the complaint will be dealt with as soon as possible. The complaint should contain your name, address, contact details and a description of the content and its location which is alleged to be in breach of this agreement.
Breach
20. If you fail to abide by these the Terms of Use when using this site we may at our sole discretion limit your use of this site or take whatever action we deem appropriate in the particular circumstances. This action may include your deleting the contributions, the relevant account or accounts being placed into pre-moderation or a temporary or permanent suspension of your ability to participate in any or all of mediaforum.ie discussion areas. mediaforum.ie reserves the right to delete any contribution, or take action against any account, at any time, for any reason. Failure to act with respect to any breach of any rule whatsoever by you or any other user shall in no way effect our future right to act with respect to future similar breaches.
General
21. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
22. These terms shall be governed by and interpreted in accordance with the laws of the Republic of Ireland.
